Opals Terms of Use

These Terms govern your use of Opals, an educational augmented reality application for Spectacles operated by Armand Sumo as a personal project.

1. Using Opals

You may use Opals only if you meet Snapchat’s eligibility requirements and can legally agree to these Terms. If local law requires permission from a parent or guardian, you must have that permission.

Your use of Spectacles, Snapchat, and their related services is also governed by Snap’s terms and policies.

2. Educational experience

Opals explains precious opal, structural colour, geology, chemistry, and optics. It is provided for education and exploration. It is not professional, medical, safety, financial, gem valuation, conservation, or purchasing advice. Do not rely on it where an error could cause injury, property damage, or financial loss.

3. AI guide

Explore with a Guide uses artificial intelligence. The guide’s text and voice are generated or selected with automated systems. AI output can be incomplete, incorrect, or unexpected even when it sounds confident.

The guide operates through a restricted set of Opals controls, but you remain responsible for deciding whether to rely on an answer. Important scientific or practical claims should be checked against authoritative sources.

4. Your questions and instructions

You keep any rights you have in text or speech you submit. You give Armand Sumo limited permission to process that material only as needed to operate, secure, and support Opals as described in the Privacy Notice.

Do not submit:

• personal information about another person without permission;
• confidential, illegal, abusive, or infringing material;
• instructions intended to bypass security or service limits;
• content that could harm the application, its providers, or other users.

5. Acceptable use

You must not misuse Opals, interfere with its operation, probe or bypass its security, automate excessive requests, extract credentials, reverse engineer restricted cloud services, or use the service in violation of law or another person’s rights.

Armand Sumo may apply technical limits, refuse a request, or suspend online features when reasonably necessary to protect Opals, its providers, or users.

6. Opals content

Opals and its software, visual design, authored explanations, graphics, models, and branding are owned by Armand Sumo or the applicable licensors and are protected by intellectual property law. These Terms give you a personal, limited, non-exclusive, non-transferable, revocable right to use Opals through its intended distribution channel. They do not transfer ownership.

Third-party names, museum materials, research references, software, and other licensed content remain the property of their respective owners.

7. Privacy

The Opals Privacy Notice explains how information is processed by the application and its providers. By using online features, you direct Opals to process the information needed to provide those features. Optional diagnostic reports are sent only when you choose Send report.

8. Third-party services

Online features depend on services supplied by Snap, Supabase, OpenAI, Thinking Machines Lab, ElevenLabs, Modal, Resend, and other infrastructure providers. Their own terms and policies may also apply to their services. Armand Sumo is not responsible for third-party services outside his reasonable control.

9. Availability and changes

Armand Sumo may update, limit, suspend, or discontinue Opals or an online feature. The authored path may remain available when guide services are offline, but uninterrupted availability is not promised.

These Terms may be updated when the application, law, or service model changes. Material changes will be communicated through the application or its distribution page when reasonably possible. If you do not agree to revised Terms, stop using Opals.

10. No additional warranties

Opals is provided on an “as available” basis. To the extent permitted by law, Armand Sumo does not make additional promises that Opals will always be available, error-free, or suitable for a particular purpose.

Nothing in these Terms excludes a warranty, remedy, or consumer right that applicable law does not allow Armand Sumo to exclude.

11. Responsibility

Armand Sumo remains responsible where liability cannot lawfully be excluded, including liability for fraud, intentional misconduct, and death or personal injury caused by negligence where applicable.

To the extent permitted by law, Armand Sumo is not responsible for indirect or unforeseeable loss, loss caused by misuse, reliance on unverified AI output, or events outside his reasonable control.

These limits do not reduce mandatory rights available to consumers.

12. Ending use

You may stop using Opals at any time. Armand Sumo may restrict online features if you materially breach these Terms or if restriction is reasonably necessary for security, legal compliance, or service integrity.

Provisions concerning intellectual property, responsibility, disputes, and other provisions that by their nature should continue will survive.

13. Governing law and disputes

These Terms are governed by French law, without depriving a consumer of mandatory protections under the law of the country where they live.

Please contact [email protected] first so the concern can be addressed. Consumers may also use any court, regulator, mediator, or dispute-resolution process available under applicable law. These Terms do not require a consumer to give up a mandatory right or forum.
